Law was one of the most important and constant fields of research within the scientific production of Niklas Luhmann, a jurist by training and civil servant. After a first stage, in which he approached his object fundamentally from the legal-scientific or theoretical-legal point of view, later his approach will focus on the contribution of sociology to a modern theory of law. .
The unpublished text presented here aims to reinterpret the fundamental problems of legal science as a monograph. At the center of this ambitious project, in the form of a systemic theory of law, is the notion of contingency, the fact of alternative possibilities in social exchange and the resulting uncertainty in the formation of expectations, which make law necessary. The productivity of law is expressed, according to Luhmann, in increasingly complex constellations of justice / injustice.
