
The rigid constitutionalism has profoundly changed the nature of law and democracy, to impose limits and substantial political links, guaranteeing fundamental rights constitutionally established.
Currently, the building of constitutional democracy, as a theoretical model and as a political project, is being attacked by the asymmetry between the global nature of the economic and financial powers and the state still confines of law and democracy; by the abdication of his role by government policy, so powerless and subordinate to markets as omnipotent in relation to the weak subjects and their rights; for the overall development of the illegality or, worse, the lack of rules on the powers, both public and private.
